About the document
The Office of the Renewable Energy Regulator (ORER) is a statutory agency under the Environment and Heritage portfolio, established to administer the Government's Renewable Energy (Electricity) Act 2000, (the Act) the Renewable Energy (Electricity) (Charge) Act 2000 (the Charges Act) and the associated regulations. In combination, this package of legislation and regulation establishes the framework for the Mandatory Renewable Energy Target (MRET).
The MRET is designed to increase the contribution of renewable energy sources to Australia's electricity supplies. It operates by imposing a legal liability to source renewable energy on, generally, large wholesale purchasers of electricity. An example of a liable party under the legislation would be an electricity retailer purchasing wholesale electricity to meet retail sales obligations to customers.
The legislation also establishes rules for the participation of renewable energy generators who can create renewable energy certificates (RECs). These RECs can be traded to the liable parties to meet their individual targets.
The demand for RECs from the liable parties is met by supply from eligible parties to establish a guaranteed market for renewable energy in Australia.
The ORER administers the legislation by administering the 'entry' (or eligibility) rules and 'exit' (or liability) rules for the scheme. The arrangements surrounding transfer of RECs between the two parties occurs in a marketplace separate to the ORER.

Policy on the selection and engagement of consultants
The ORER engages consultants on a needs basis to (i) supplement the skills and experience of its own staff and (ii) provide independent advice.
The selection and engagement of consultants by the ORER is in accordance with the principles of the Commonwealth Procurement Guidelines. Value for money is the core principle governing Commonwealth procurement. Value for money is enhanced in Government procurement by:
- encouraging competition by ensuring non-discrimination and using competitive procurement processes;
- promoting the use of resources in an efficient, effective and ethical manner; and
- making decisions in an accountable and transparent manner.
These Guidelines are reflected in the ORER's Chief Executive Instructions.
Methods of selection
The methods of selection used by the ORER are as follows:
Open Tender: A procurement process that involves a request for tender and accepting all submissions received before the deadlines for submissions from any potential suppliers who satisfy the conditions for participation.
Select Tender: A procurement process that involves issuing an invitation to tender to those potential suppliers selected in accordance with procedures outlined in the Commonwealth Procurement Guidelines - January 2005.
Panel: A panel may be established by an agency by entering into contracts or deeds of standing offer for the provision of identified property or services for a pre-determined length of time, usually at a pre-arranged price. A panel can be established by open tender or select tender.
Direct Sourcing: A procurement process permitted only under certain conditions (see Commonwealth Procurement Guidelines - January 2005) in which an agency may invite a potential supplier or suppliers of its choice to make submissions.
