Regulatory Plan

Commonwealth agencies that have a responsibility for business regulation are required to publish a regulatory plan each financial year.

A regulatory plan covers business regulation. This includes primary legislation (Renewable Energy (Electricity) Act 2000 and Renewable Energy (Electricity) Charge Act 2000) or subordinate legislation (Renewable Energy (Electricity) Regulations 2001) which directly affects businesses, has a significant indirect effect on businesses, or restricts competition.

A regulatory plan provides details relating to legislative changes that have occurred or are proposed within a given financial year. Regulatory plans allow businesses an opportunity to view changes:

  • to business regulation which have occurred since the beginning of the previous financial year; and
  • planned in the current financial year which could lead to changes to business regulation.

A regulatory plan does not include information about regulation amendments that:

  • are minor or machinery in nature, as these amendments do not substantially alter existing arrangements; and
  • anticipate activity about which it would be inappropriate to publish information on grounds of confidentiality.

Appealing a Renewable Energy Regulator's Decision or Lodging Objections

A person who has received a decision from the Renewable Energy Regulator may be able to lodge a formal review request for the Renewable Energy Regulator to reconsider the decision under Part 6 of the Renewable Energy (Electricity) Act 2000 (the Act), Part 8 of the Renewable Energy (Electricity) Regulations 2001 (the Regulations) or Regulation 11 of the Renewable Energy (Electricity) Amendment (Transitional Provision) Regulations 2010 (the Amendment Regulations). Tables of reviewable decisions are provided in each of the below fact sheets.

Information Publication Plan

The Office of the Renewable Energy Regulator (ORER) is an agency subject to the Freedom of Information Act 1982 (FOI Act). As such, ORER is required to comply with the requirements of the Information Publication Scheme (IPS), under which ORER must publish:

  • the Information Publication Plan (agency plan) which outlines how ORER proposes to meet the IPS requirements, and
  • certain types of information specified in the FOI Act.

The agency plan describes:

  • what information ORER intends to publish;
  • how and to whom ORER proposes to publish the information; and
  • how ORER proposes to comply with the scheme.

Contract Listing - Senate Order

In response to a Senate Order dated 20 June 2001, the Office of the Renewable Energy Regulator will include the following contract information on this website:

  • each contract entered into by the ORER which has not been fully performed or which has been entered into during the previous 12 months, and which provides for a consideration to the value of $100,000 or more;
  • the contractor, the amount of the consideration, the subject matter of each such contract, the commencement date of the contract, the duration of the contract and the 12 month period relating to the contract listings;
  • whether each such contract contains provisions requiring the parties to maintain confidentiality or any of its provisions, or whether there are any other requirements of confidentiality, and a statement of the reasons for the confidentiality; and
  • an estimate of the cost of complying with this order and a statement of the method used to make the estimate.

File Lists - Senate Order (Harradine motion)

Indexed list of files created by the Office of the Renewable Energy Regulator

On 14 November 1994, the Senate agreed to a motion by Senator Harradine requiring all Australian Government departments and agencies to produce an indexed list of files every six months for tabling before parliament. The production of the list is intended to make the operations of government more transparent to the Australian public.

As part of the Governments ongoing commitment to give Australians greater access to relevant government information quickly and easily, the original Senate Order was amended in 1998 and now requires departments and agencies to also list these files on their websites.

The lists are tabled twice a year, once in the Spring sittings and once in the Autumn sittings:

  • Spring sittings - files created in the preceding July to December; and
  • Autumn sitting - files created in the preceding January to June.

Under the Freedom of Information Act 1982 (FOI Act), members of the public can seek access to documents contained on any of the files listed here.
